Terms and Conditions

Your access to and use of this website, including its subdomains, associated websites and extranets (each a “Site” and collectively the “Sites”) constitutes your or the entity you represent’s acceptance of the following terms and conditions of use (the “Terms of Use”). If you do not agree to these Terms of Use, you may not access or use the Sites. Additional terms and conditions (including age requirements) may apply to your access to and use of certain Site Materials or Features (as defined below) (the “Special Terms”). The Special Conditions shall be made available together with the relevant Materials or Site Features and shall form part of these Terms of Use at the time the User (as defined below) accesses or uses such Materials or Site Features.

The World Food Programme (“WFP”) maintains the Sites as a courtesy to anyone who chooses to access any Site (a “User”). The information presented on the Sites is for informational purposes only. Unless otherwise provided in the applicable Special Terms, WFP authorises the User to visit the Sites and to download and copy the information, documents and WFP material contained on the Sites (collectively, the “Materials”) for the User’s personal, non-commercial use, without any right to resell or redistribute them or to compile or create derivative works therefrom, subject to these Terms of Use and provided that the source is fully acknowledged.

Unless expressly stated otherwise, the findings, interpretations and conclusions expressed in the Material are those of the individual WFP staff members, consultants and advisors who prepared the work, and do not necessarily represent the views of WFP. The designations employed and the presentation of material in the Sites do not imply the expression of any opinion whatsoever on the part of WFP concerning the legal or development status of any country, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries.

Third party content appearing on the Site may only be used with the consent of its owner or as permitted by applicable law, as the case may be. Nothing in these Terms of Use shall be deemed to confer any rights or benefits to any third party in any such content.

1. Disclosure of information

WFP is committed to making information about its operations and programmes available to the public. WFP believes that public access to information contributes to a better understanding of WFP’s unique mission and enhances stakeholder participation in the fight against world hunger. 2. Site Features

The Sites may contain noticeboards, extranets, social networking and platforms, access to mailing lists or other messaging or communication services and other applications (collectively, the “Site Features”). The Site Features may be subject to special conditions. You agree to use the Site Features only to send and receive information, content and materials appropriate and related to the particular Site Feature. By way of example and not as a limitation, the User agrees that, in using a Site Feature, the User will not do the following:

1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
2. Publish, post, send, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information; 3;
3. Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity), unless the User owns or controls the rights thereto or has received all consents thereto that may be required by law;
4. Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of WFP’s or third parties’ systems;
5. Circumvent, disable or interfere with the Sites, the Materials or the Site Features; 6;
6. Delete any author attributions, legal notices or proprietary designations or labels in any file or content that is uploaded; 7;
7. Falsify the origin or source of software or other material contained in a file or uploaded content; 8;
8. Take any action that could damage or impair any right of WFP hereunder, or the goodwill associated with its name or the name of the United Nations or any organization in the United Nations system;
9. Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download or use any file or content posted by another user of a Site Feature that the User knows, or reasonably should know, may not be lawfully downloaded or used in such manner.

The User acknowledges that certain Features of the Site are publicly accessible and communicated. User further acknowledges that any postings, communications, content and any other materials that User or other users of this Site post, submit, upload or otherwise provide to this Site (“Submissions”) are not endorsed by WFP and shall not be deemed to have been reviewed, screened or approved by WFP. WFP does not claim ownership of any Submissions provided by User or other users of this Site. However, by posting, submitting, uploading or otherwise providing the Submissions, User grants to WFP a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable and transferable license to use, display, distribute, reproduce, modify, remix, translate, transcode, extract, adapt, prepare derivative works and compile, publicly perform and publicly display any or all of the Submissions in any form or medium for any purpose in connection with WFP.

WFP accepts no liability whatsoever in respect of the conduct of Users in connection with the Site Features, nor in respect of the Submissions, and the User waives all rights to bring claims against WFP for any cause of action arising out of the User’s use of the Submissions.

3. Personal Information

The collection, retention, and use of personal information by WFP through the Sites are subject to the currently effective WFP Privacy Policy, which can be found at https://es.wfp.org/politica-de-privacidad.

4. Donations in Support of WFP

Certain features of the Site may allow Users to make donations in support of WFP and its projects and activities, using various means such as credit cards, debit cards, and other payment methods (each, a “Payment Method”). Donations can take the form of direct contributions to WFP or indirect support through contributions to cooperating partners in different territories, in which case additional conditions may apply.

By providing information regarding a Payment Method, the User declares, acknowledges, and agrees that: (i) they are authorized to use that Payment Method, and (ii) they will be solely responsible for any fees charged by the User’s financial institution or other provider of the Payment Method. When the User makes a donation, they authorize WFP (and its designated payment processor) to collect, process, and store information related to the relevant Payment Method and other transaction-related information to carry out the transaction and help manage donors and donations more effectively.

WFP takes all reasonable precautions to ensure that all donations and related transactions are conducted through a secure link. However, the security of information and payments transmitted over the Internet cannot be guaranteed. The User acknowledges and agrees that (i) donations to WFP are made at the User’s discretion and risk, and (ii) WFP has no responsibility for (a) any loss the User may suffer if a third party gains unauthorized access to any information provided by the User, and (b) any act or omission of the User’s financial institution, credit card, debit card, or other payment method provider, telecommunications service providers, or any third party in connection with donations to WFP and related transactions.

If your mandate involves a monthly charge, you can modify or cancel the charge on your account at any time by sending an email to ecuador.donantes@wfp.org and including a copy of your identification document. Please note that any changes may take between 3 and 5 days to process.

WFP relies on Pagoplux S.A. to process payments by direct debit. You can find more information on how Pagoplux S.A. processes your personal data at https://www.pagoplux.com/politicas-de-privacidad/. WFP ensures that your personal data is processed exclusively for donation and related communication purposes and is retained only for evidentiary purposes.

5. Disclaimer. User Indemnification

The use of the Sites, Materials, and Site Features is at the User’s sole risk and responsibility. The Sites, Materials, and Site Features are provided “as is” and “as available,” without any warranty, express or implied, including, but not limited to, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Specifically, WFP does not warrant the accuracy or completeness of the Sites, Materials, or Site Features. WFP may add, modify, improve, or update the Sites, Materials, and Site Features periodically without notice. The User expressly acknowledges and agrees that WFP is not responsible for the conduct of any User.

The Sites may contain advice, opinions, and statements from various information providers. WFP does not endorse or represent the accuracy or reliability of any advice, opinion, statement, or other information provided by any information provider, User of this Site, or any other third party. The User’s reliance on such advice, opinions, statements, or other information is also at their own risk.

The Sites may contain links and references to third-party websites. Linked sites are not under the control of WFP, and WFP is not responsible for the content of any linked site or any link contained in a linked site. WFP provides these links solely for convenience, and the inclusion of a link or reference does not imply WFP’s endorsement of the linked site.

WFP, its staff, officers, employees, information or content providers will not be liable in any case for losses, damages, liabilities, or expenses incurred or claimed as a result of the use of the Sites, Materials, or Site Features, including, among others, failures, inaccuracies, errors, omissions, interruptions, or delays, deletions, defects, alterations, or use, in relation to them, infection by viruses, or any other type of contamination by any element with destructive properties, communication line failure, regardless of the cause. Under no circumstances, including negligence but not limited to it, will WFP be liable for any direct, indirect, incidental, special, or consequential damages, even if WFP has been advised of the possibility of such damages.

As a condition for the use of the Sites, Materials, and Site Features, the User agrees to indemnify WFP, its staff, officers, and employees for any action, claim, loss, damage, liability, and expense (including reasonable attorney fees) arising from the User’s use of this Site, including, among others, claims alleging facts that, if true, would constitute a breach by the User of these Terms of Use. If the User is not satisfied with any Site, Material, Site Feature, or any provision of these Terms of Use, the User’s sole and exclusive remedy is to stop using the Site.

6.Preservation of Immunities

Nothing in these Terms of Use or the Special Conditions will imply a waiver, express or implied, by WFP, the United Nations, and the Food and Agriculture Organization of the United Nations, of any privileges and immunities they may enjoy under the 1946 Convention on the Privileges and Immunities of the United Nations, the 1947 Convention on the Privileges and Immunities of the Specialized Agencies, customary international law, other relevant international or national agreements, and domestic law.

7. Miscellaneous

WFP reserves the exclusive right, at its sole discretion, to (i) alter, limit, or discontinue in any way the Site, any of the Materials, or Site Features; (ii) modify these General Terms of Use or any Special Conditions. WFP has no obligation to consider the needs of any User in connection with the foregoing.

WFP reserves the right to deny, at its sole discretion and without prior notice, access to any user to this Site or any part thereof, and to suspend, revoke, or cease providing user accounts if the user does not comply with the Terms of Use or any Special Conditions, as well as to delete, for any reason and without prior notice, any Submission.

The name, emblem, and abbreviation of WFP (the “WFP Marks”) are the exclusive property of WFP and are protected by international law. Unauthorized use of WFP Marks is prohibited. WFP Marks may not be reproduced or used in any way without the prior written permission of WFP.

The mention or omission of specific companies, their products, or brands on the Sites does not imply any endorsement or judgment by WFP.

The User will not remove, hide, or alter any legal notice appearing on the Materials or Site Features or alongside them.

WFP reserves the right to pursue all available legal remedies for violation of these Terms of Use, including WFP’s rights to the Sites, Materials, Site Features, and Submissions. WFP’s waiver of any provisions of these Terms of Use will only be binding if made in writing and signed by its duly authorized representative.

These Terms of Use and any dispute arising from them will be exclusively governed by the international principles of international law, excluding any national legal system.

Any dispute, controversy, or claim arising out of or relating to these Terms of Use, or the breach, termination, or invalidity thereof, or the use of the Sites, Materials, and Site Features by the User or any content available on them and their specific conditions of use will be resolved through Arbitration in accordance with the UNCITRAL Arbitration Rules in force at that time. The arbitral tribunal, consisting of 1 (one) arbitrator, will be empowered to order (i) the return or destruction of property or any other property, tangible or intangible, or any confidential information provided under this; (ii) the termination of this; or (iii) any other protective measure regarding property, services, or any other property, tangible or intangible, or any confidential information provided under this, as appropriate, all in accordance with the authority of the arbitral tribunal under Article 26 (“Interim Measures”) and Article 34 (“Form and Effect of the Award”) of the UNCITRAL Arbitration Rules. The arbitral tribunal will not have the authority to award punitive damages. WFP and the User will be bound by any arbitral award issued as a result of such arbitration as a final resolution of any dispute. The language of the proceedings will be English.

To the extent that there is more than one language version of these Terms of Use and there is any inconsistency between the versions, the English version will always prevail.
